    $16.5-million settlement in G20 class action could bring lasting police changes, says co-counsel

    Toronto lawyer Eric Gillespie has a general rule: Launch only one marathon class action lawsuit per decade. It’s a good policy because it took 10 years for Gillespie and co-counsel Murray Klippenstein to reach a landmark, $16.5 million, mediated settlement with the Toronto Police Service in a class action launched in August 2010 over the mass arrest and detention of hundreds of largely peaceful protesters at the June 2010 G20 Summit in Toronto.

    B.C. law society seeking feedback on trust account rule change proposal

    According to the provincial law society, lawyers in B.C. have raised concerns about the impact that the law society’s rule 3-58.1 (Trust account only for legal services) has had on retainers received by a lawyer who has been appointed as a mediator, arbitrator or parenting co-ordinator and who will be providing some incidental related legal services to the parties, such as the preparation of the mediation or arbitration (or related settlement) agreement.

    B.C. introduces legislation designed to modernize domestic arbitration regime

    The B.C. government has put in motion plans to update its domestic arbitration rules, a move it says is necessary to reflect best practices at both the national and international level. The bill, which is before the provincial legislature, is a full repeal and replacement of the current Arbitration Act and builds on recommended changes from the Uniform Law Conference of Canada’s Uniform Arbitration Act and will better align with provincial legislation on international arbitral disputes.
