The appellant was convicted of historical sexual offences against his two stepdaughters and received a global sentence of seven years imprisonment. The appellant appealed on three grounds. First, he argued that the trial judge improperly used his provincial driving record to draw adverse inferences about his character and credibility. Secondly, the trial judge misapprehended his evidence concerning the "Naked News" show, which his stepdaughter S claimed he was watching on television during one of the incidents where she said he committed the sexual offence. Lastly, the trial judge failed to properly apply the burden of proof.
