Law360 Canada ( December 3, 2024, 3:23 PM EST) -- Appeal by Shodunke from decision upholding dismissal of his second complaint against his former employer, Paladin Security Group Ltd. (Paladin). Shodunke filed two complaints against Paladin with the Alberta Human Rights Commission. The first complaint alleged that Paladin terminated Shodunke’s employment based on his religious belief and colour. Paladin denied Shodunke’s allegation. Paladin reasoned that it terminated Shodunke’s employment because of his work performance. The second complaint concerned an incident at a public mall where Shodunke alleged that Paladin instructed a security guard to remove him from the mall in retaliation for threatening to report Paladin to "appropriate authorities", and that the removal constituted discrimination. Paladin denied the allegations and stated that Shodunke was removed from the mall due to his behaviour. Paladin submitted incident reports to support its position. A human rights officer and the Director dismissed both complaints. Shodunke sought a review by the Chief of the Commission, which was also dismissed. Shodunke applied for judicial review of the Commissioner's decision. The chambers judge found the decision on the first complaint unreasonable but upheld the decision on the second complaint as reasonable. The decision on the first complaint was not under appeal....
