A Virginia school board asked the Fourth Circuit to stay its ruling that federal law requires schools to let transgender students choose which bathrooms to use, arguing Tuesday there are vital questions about separation of powers and privacy the board will raise at the U.S. Supreme Court.

4th Circ. Backs Transgender Student's Use Of Boys' Bathroom
The Fourth Circuit said that a Virginia school board’s decision to not let a transgender male student use the boys’ bathroom violated Title IX of the education code, and ordered the lower court to allow hearsay testimony when determining whether the student should be granted a preliminary injunction.
