The Self-Insurance Institute of America told the Sixth Circuit on Thursday that Michigan cannot continue to maintain that its health insurance tax laws do not interfere with the administration of plans under the Employee Retirement Income Security Act after the U.S. Supreme Court ruled in a similar case.

The Sixth Circuit on Monday axed a lawsuit claiming Employee Retirement Income Security Act plans are exempt from a Michigan health insurance tax law because the law interferes with plan administration, ruling the tax is a general applicability provision that doesn't specifically burden plans.
