HHS Can't Force 'Unlimited' Drug Discounts, 3rd Circ. Says
Drugmakers don't have to sell their products at a discount through an unlimited number of retail pharmacies just because those pharmacies partnered with health care providers for low-income or uninsured patients under a federal program, the Third Circuit ruled Monday.

HHS, Drug Cos. Spar Over Pharmacy Limits In Discount Law
The limited number of hospitals with in-house pharmacies serving underprivileged communities meant a federal drug discount program had to gradually expand to include retail pharmacies, and that program should bar drugmakers from restricting which pharmacies can order the discounted drugs, an attorney for the U.S. Department of Health and Human Services argued to a Third Circuit panel Tuesday.
