    5th Circ. Lets BofA, MERS Off Hook For County Deed Records

    The Fifth Circuit affirmed Friday that Harris, Dallas and Brazoria counties did not show Texas law required Bank of America Corp. and Merscorp Holdings Inc. to record deeds of trust with those counties, and that Dallas did not adequately show either misrepresentation or unjust enrichment.

    MERS, BofA Urge 5th Circ. To Boot Counties' Fraud Suit

    Merscorp Holdings Inc. and Bank of America Corp. have urged the Fifth Circuit to uphold the dismissal of a suit brought by Texas counties accusing them of fraudulent mortgage registration practices, saying there was no proof of misrepresentation or a failure to carry out any legal duties.
