Dyson Decision Highlights Post-Brexit Forum Challenges

Dyson Technology Ltd.,[1] the High Court of Justice of England and Wales refused to allow group supply chain claims to proceed further against companies in the Dyson group. The court's refusal was based on so-called forum non conveniens grounds, i.e., that the foreign jurisdiction Malaysia, where the alleged acts and omissions occurred, was a more appropriate forum and justice did not otherwise require that the claims be tried in England....
