A New York federal judge on Tuesday granted conditional certification to a 42,000-worker nationwide class of tipped TGI Friday's employees in a collective action alleging they had to perform underpaid side work in violation of the Fair Labor Standards Act.

A putative class suing T.G.I. Friday's owner Carlson Restaurants Inc. for allegedly making tipped employees perform unpaid side work blasted the company for "picking off" plaintiffs with individual settlement offers, in the hopes of killing the suit, the plaintiffs' attorneys wrote in a letter to New York federal judge Analisa Torres on Thursday.

T.G.I. Friday's Inc. urged a New York federal judge Friday to trim a minimum wage claim from a collective action alleging that various tipped workers were forced to perform unpaid "side work," saying that the plaintiffs wrongly interpreted laws about tipping employees.
