The D.C. Circuit unanimously ruled Friday that the U.S. Department of Labor wrongfully revoked Knight Hawk Coal's ventilation plan for an Illinois mine and refused to disturb a Federal Mine Safety and Health Review Commission decision that reinstated the plan.

A D.C. Circuit judge came out swinging Tuesday against the U.S. Department of Labor Eugene Scalia's decision to revoke a ventilation plan at Knight Hawk Coal's Prairie Eagle-Underground mine in Cutler, Illinois, a move that has stalled the company's effort to squeeze more coal from the location.

The D.C. Circuit has refused to immediately halt certain operations at an Illinois coal mine after the U.S. secretary of labor, through the Mine Safety and Health Administration, raised concerns about a ventilation plan that allegedly would not protect worker safety.
