A group of Amazon workers in Staten Island may seek an order forcing the company to revamp its COVID-19 safety practices under state law, but not on the basis that the alleged safety lapses posed a "public nuisance," a Second Circuit panel said in a Tuesday decision partially reviving the lawsuit.

Federal judges should be willing and able to assess COVID-19 workplace safety, counsel for Amazon.com workers told the Second Circuit Wednesday, after an appellate judge sympathized with the jurist who kicked their case to the Occupational Safety and Health Administration.
