The National Labor Relations Board must explain why it applied one legal test over another when analyzing whether a union representation election at a Chicago cannabis dispensary was fair, the D.C. Circuit said Tuesday, sending the dispensary's challenge to union certification back to the board.

The NLRB on Tuesday defended its decision to overrule a Chicago cannabis dispensary's objections to a representation election and require the company to bargain with a union, telling the D.C. Circuit that evidence didn't support the company's claim that a board agent engaged in misconduct during the vote.
