A farm's appeal challenging whether the U.S. Department of Labor could appoint the quasi-judicial board that OK'd a nearly $557,000 fine will wait for the U.S. Supreme Court to mull a similar issue involving the U.S. Securities and Exchange Commission, the Third Circuit ruled.
