A North Carolina federal judge has ruled that former assistant Bojangles managers claiming they were wrongfully denied overtime pay have shown they are similarly situated, but that they haven't justified certification of a Fair Labor Standards Act collective action with a geographic scope beyond the Tar Heel State.

Two former Bojangles employees asked a North Carolina federal court Wednesday to certify a collective of assistant managers, arguing that they all engaged in similar, non-overtime-exempt work and were uniformly classified as overtime-exempt.

Assistant restaurant managers for fried chicken chain Bojangles are managers in name only and are thus entitled to time-and-a-half overtime pay under the Fair Labor Standards Act, workers said in a proposed collective action filed in North Carolina federal court.
